RELEASE AND WAIVER OF LIABILITY
This Release and Waiver of Liability (the "Release") executed today by the Participant and in favor of David Mosner, Inc. dba Mosner Family Brands, their directors, officers, employees, and agents (collectively, "Mosner"). The Participant desires to enroll in a class instructed by Mosner and engage in the activities related to being a Participant.
The Participant hereby freely, voluntarily, and without duress executes this Release under the following terms:
Release and Waiver. Participant does hereby release and forever discharge and hold harmless Mosner and its successors and assignees from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Participant’s activities with Mosner. Participant understands that this Release discharges Mosner from any liability or claim that the Participant may have against Mosner with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Participant’s activities with Mosner, whether caused by the negligence of Mosner or its officers, directors, employees, or agents or otherwise. Participant also understands that Mosner does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance in the event of injury or illness. It is the policy of Mosner that the minimum age to participate is age 18.
Assumption of Risk. Participant understands that the activities include aspects that may be hazardous (that is, that can cause serious physical injury or death) to the Participant, including, but not limited to, working with sharp tools. Participant agrees to enroll with full knowledge of the dangers and potential injuries involved. Participant hereby expressly and specifically assumes the risk of injury or harm in the activities and releases Mosner from all liability for injury, illness, death, or property damage resulting from the activities and/or Participant’s negligence. Participant also agrees to indemnify Mosner for any injury they cause another.
Scheduling and Payment. Participant understands that class scheduling is subject to change and availability. Cancellation policy for students is 7 days notice to Mosner prior to scheduled class. Mosner reserves the right to cancel any class with reasonable notice given to all Participants. If class is canceled, Participants shall be refunded in full.
Other. Participant expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of New York, and that this Release shall by governed by and interpreted in accordance with the laws of the State of New York. Participant agrees that if there is any dispute with David Mosner, Inc. dba Mosner Family Brands, it will be resolved by binding arbitration in the State of New York, based upon the rules of the American Arbitration Association and New York law. Participant agrees that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable.
